Terms of Service

These Terms of Service govern the contractual relationship between: LUMY.MEDIA SAS, a simplified joint-stock company with a capital of €2,000, registered with the Brest Trade Register under number B 889 608 790, with registered office at Quai de la Douane, Bâtiment LE GRAND LARGE, 29200 Brest, France (hereinafter "Louez.io" or "the Provider") and Any natural or legal person subscribing to the service (hereinafter "the Client") for the provision of the SaaS rental management platform service accessible at app.louez.io.

Louez.io is a SaaS (Software as a Service) platform enabling professionals and individuals to manage their equipment rental business. The service includes: Basic features: - Creation and customization of an online store - Rental product catalog management - Reservation and calendar management - Automatic rental contract generation (PDF) - Electronic signature of contracts - Customer management Advanced features (depending on plan): - Online payment and deposit management - Automatic SMS sending - Statistics and dashboards - Dedicated customer portal - Custom domain

Start Plan (Free): - Maximum 5 products - 1 user account - Online store - Contracts with electronic signature - Chat support Pro Plan: €59 excl. VAT/month - Maximum 50 products - 2 collaborator accounts - All Start features - Online payment and deposit - Automatic SMS - Customer portal - Priority support - Detailed statistics ULTRA Plan: €159 excl. VAT/month - Unlimited products - Unlimited collaborators - All Pro features - Custom domain - Review booster - Phone support - Dedicated account manager All prices are shown excluding taxes. Applicable French VAT (20%) will be added at billing.

Account creation: Using the service requires creating an account with a valid email address. The Client guarantees the accuracy of the information provided. Account responsibility: The Client is responsible for the confidentiality of their credentials and all activities carried out from their account. Collaborator accounts: Depending on the subscribed plan, the Client may create accounts for their collaborators. The Client remains responsible for the use of the service by their collaborators.

Methods: - Payment by credit card via our secure provider Stripe - Automatic monthly direct debit on anniversary date - Electronic invoicing sent by email Payment default: In case of payment default, Louez.io reserves the right to suspend access to the service after an email reminder. Access will be restored upon regularization. Price changes: Louez.io reserves the right to modify its prices. New prices will be communicated with 30 days notice and will only apply to new subscriptions or renewals.

Duration: The subscription is taken out for an indefinite period, with no minimum commitment. Cancellation by the Client: The Client may cancel their subscription at any time from their account area. Cancellation takes effect at the end of the current billing period. No pro-rata refund is made. Cancellation by Louez.io: Louez.io may terminate the contract in case of violation of these Terms, after formal notice remaining without effect for 15 days. Consequences of cancellation: - Access to the service maintained until the end of the paid period - Data export possible for 30 days after the end of the subscription - Permanent deletion of data after this period

Client data: The Client remains the owner of all data entered in the service (products, customers, reservations, etc.). Data export: The Client may at any time export their data in a standard format (CSV, PDF). Use by Louez.io: Louez.io only uses the Client's data to provide the service. No data is sold or shared for commercial purposes.

Availability commitment: Louez.io commits to 99.5% service availability, excluding scheduled maintenance. Maintenance: Maintenance operations are preferably carried out during off-peak hours. Scheduled maintenance is announced with 48 hours notice. Interruptions: Louez.io cannot be held responsible for interruptions due to external causes (host, internet, force majeure).

Limitation of liability: Louez.io's liability is limited to direct and foreseeable damages, up to the amounts paid by the Client over the last 12 months. Exclusions: Louez.io cannot be held responsible for: - Indirect damages (loss of revenue, data, opportunity) - The use made by the Client of the service - Content entered by the Client - Relations between the Client and their own customers

License to use: Louez.io grants the Client a non-exclusive, non-transferable license to use the service for the duration of the subscription. Open Source: The source code of Louez.io is distributed under an open source license. License conditions are available on our GitHub repository. Trademarks: Louez.io and its logo are registered trademarks of LUMY.MEDIA SAS.

Louez.io commits to processing personal data in accordance with GDPR and its Privacy Policy. Subcontracting: In the context of service provision, Louez.io acts as a data processor within the meaning of GDPR for the data of the Client's end customers (renters). A Data Processing Agreement is available upon request.

Neither party shall be held responsible for a failure to fulfill its obligations due to force majeure as defined by French case law (unforeseeable, irresistible and external event).

Louez.io reserves the right to modify these Terms. Modifications will be notified by email at least 30 days before their entry into force. Use of the service after this date constitutes acceptance of the new conditions.

These Terms are governed by French law. In case of dispute, the parties agree to seek an amicable solution. Failing agreement, the dispute will be brought before the Commercial Court of Brest.
